We view data privacy as a fundamental component of doing business. Our privacy policy and practices are focused on processing personal data appropriately and lawfully, while providing confidentiality, integrity and availability.

This privacy statement applies to www.you-claim.com, with the terms “YouClaim”, “we”, “us”, or “our”, referring to the whole company group or each of the companies as the case may be.

This privacy statement represents the full online privacy policy applicable to our activities including the types of information we collect, how we use, share, and secure any provided information. It also outlines user choices regarding use, access and correction of user personal data.

We retain and process personal data to fulfil our contractual obligations to claimants, to enable us to provide our services on their behalf.  We only process data when we have a lawful reason for doing so.  The lawful reason we use to process your personal data may differ for each processing activity.  Any personal information that we collect for contractual purposes is processed under a legitimate interest and consent.

YouClaim is considered to be the data controller and will determine the purposes and means of the processing of personal data.

General Data Protection

YouClaim complies at all times with its obligations under GDPR and DPA 2018, taking appropriate technical and organisational measures against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to personal or special personal data. 

The company shall have regard to the state of good practice, technical development and the cost of implementing any measures to ensure a level of security appropriate to the harm that might result from such unauthorised or unlawful processing or accidental loss or destruction, and to the nature of the data to be protected.

Moreover, YouClaim will do its utmost to store your data within a Member State of the European Union. However, there may be occasions where we need to share your data with entities in third countries such as when we are using cloud software providers or outsourced contractors which enable us to provide you with the services. We verify that any data transfer outside of the EEA is subject to the UK and EU adequacy requirements, Standard Contractual Clauses or other transfer tools which comply with data protection legislation

Definitions

Also, the capitalised terms below shall have the same meaning as in our Terms And Conditions.

1.0 Personal data

Personal data means any information relating to an identified or identifiable natural person and includes all types of information such as names, dates of birth, addresses, e-mail addresses, telephone numbers etc.

2.0 Collection of personal data

All personal data is collected in accordance with the GDPR & GPA 2018. 

Additionally, in order to make use of YouClaim’s service we will request claimants to provide personal data and this personal data may be submitted via our website, email, phone, post or any other electronic or software solution for the purpose of delivering our business service in accordance with the agreement.

Also, we collect personal data such as names, dates of birth, addresses, e-mail addresses, telephone numbers and flight details to enable us to submit claimant flight disruption details to an airline. 

3.0 Use of personal data

We retain claimant information for as long as their account is active or as needed to provide services, comply with our legal obligations or any of the purposes listed above. 

Also, we use personal data only for the purpose it is collected and we do not retain claimant data any longer than necessary for that specific purpose.

We process personal data only to the extent required for our specified, explicit and legitimate business purpose or as may be required for legal reasons.

4.0 Personal data sharing

We only transfer the personal data to third parties under the conditions as listed below:

  • If claimant has given consent
  • If it is for a purpose directly related to the original purpose for which the personal data was collected
  • If it is necessary for the preparation, negotiation and fulfilling the agreement with a claimant
  • If it is required due to legal obligation, administrative or court order
  • If it is required for the establishment or protection of legal claims or in defence of court actions
  • If it is required for responding to lawful requests by public authorities, including to meet national security or law enforcement requirements
  • If it serves the prevention of misuse or other illegal activities, such as deliberate attacks, to ensure data security

Additionally, we may work with other companies, both inside and outside the EU, such as technology companies, to work on our behalf for processing and delivery of systems and technologies to enhance our products and services, and we may share necessary information with them. 

However, before we share personal information, we enter into written agreements with the recipients which contain data protection terms that safeguard your data and such companies will only be permitted to obtain the personal data required to deliver their service. 

And, of course, we do not disclose personal data to third parties for the purpose of allowing them to market their products or services to you.

5.0 Data protection rights

YouClaim undertakes to comply with the rights of subjects as identified in GDPR and DPA 2018 as follows:

  • The right to be informed
  • The right of access
  • The right to rectification
  • The right to erasure
  • The right to restrict processing
  • The right to data portability
  • The right to object
  • Rights in relation to automated decision making and profiling

6.0 YouClaim data responsibility

This privacy statement is under the responsibility of the DPO to ensure compliance on an on-going basis and the DPO will have involvement in all issues related to the protection of personal data.

We maintain records of processing activities under our responsibility containing the information required by the GDPR and where applicable make the records available to the supervisory authority on request.

7.0 Marketing emails 

Should any website user or claimant consent to receiving marketing emails YouClaim may send them emails which will contain information which we believe may be of interest, such as the latest news on our products and services.

And, of course, if you no longer wish to receive marketing emails you may unsubscribe at any time by using our “Unsubscribe” link found in the marketing emails.

8.0 Use of Cookies

Our website and our partners use cookies or similar technologies to ensure the best user experience and to analyse trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. Cookies are small text files that are placed on your device to track usage patterns and record preferences.

Our cookies do not contain information that can directly identify persons. We gather certain information automatically by the use of cookies and tracking technologies such as Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring/exit pages, the files viewed on our site (e.g. HTML pages, graphics), operating system, date/time stamp, and/or clickstream data to analyse trends in the aggregate and administer site. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit the use of certain features or functions on our website or service

9.0 Complaint

You have the right to file a complaint concerning our processing of your personal data. All queries and complaints shall be handled in a timely manner by the DPO in accordance with internal procedures. Complaints can be submitted to the DPO email: claims@you-claim.com.

In the unlikely event that you consider that our processing of your personal data infringes the GDPR, or any other data privacy law, you may also lodge a complaint with a supervisory authority.

10.0 Changes to this Privacy Statement

This privacy statement may be updated periodically and it will be the responsibility of website users to ensure that they have read the privacy statement before entering into any agreement with YouClaim to undertake any claim submission service on a user’s behalf.
